Welcome to Empac Emperors Susu Enterprise ("Empac Emperors", "we", "us", or "our"), a susu firm located in Ghana. Our website, www.empacsusu.com, and our mobile applications on Android and iOS platforms (collectively, the "Platform") are provided to help you save money and access financial support in the form of loans called Advanced Deposit Withdrawal.

Please read these Terms of Service ("Terms") carefully before using the Platform, as they govern your access to and use of the Platform and our services (collectively, the "Services"). By accessing and using the Platform and Services, you agree to be bound by these Terms and all applicable laws and regulations in Ghana. If you do not agree to these Terms, you are not authorized to use the Platform or Services.

To use the Platform and Services and become a member of Empac Emperors Susu Enterprise, you must be at least 18 years old, have the legal capacity to enter into a binding contract, and reside in the Volta Region of Ghana. By using the Platform and Services, you represent and warrant that you meet these eligibility requirements.

Registration and Account Security

To access certain features of the Platform and Services, you may be required to create an account. When creating an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account information, including your username and password, and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We reserve the right to terminate your account at any time, for any reason, without notice.

Your privacy is important to us. Please review our Privacy Policy, which is incorporated into these Terms by reference, to understand our practices regarding the collection, use, and disclosure of your personal information.

Compliance with Laws

You agree to comply with all applicable laws, rules, and regulations in Ghana, including but not limited to the Banking Act, 2020 (Act 1036), the Borrowers and Lenders Act, 2008 (Act 773), and the Data Protection Act, 2012 (Act 843), when using the Platform and Services.

Services

Empac Emperors Susu Enterprise provides a susu scheme that allows members to save money and access financial support in the form of loans called Advanced Deposit Withdrawal. The specific terms and conditions for these Services, including the interest rates, repayment terms, and eligibility requirements, will be provided to you separately and are subject to change at our sole discretion.

Fees and Charges

By using our Services, you agree to pay any applicable fees and charges as outlined in the fee schedule provided to you separately. We reserve the right to change our fees and charges at any time, with or without notice. Failure to pay any fees or charges may result in the suspension or termination of your account and Services.

Termination

We reserve the right to terminate your account and access to the Platform and Services at any time, for any reason, without notice. Upon termination, all provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Ghana. Any disputes arising out of or in connection with these Terms, the Platform, or the Services shall be resolved through amicable negotiations. If the parties fail to reach an agreement within thirty (30) days from the date the dispute was first raised, either party may refer the dispute to arbitration in accordance with the Alternative Dispute Resolution Act, 2010 (Act 798).

Changes to the Terms

We reserve the right to modify or replace these Terms at any time, in our sole discretion. We will notify you of any changes by posting the updated Terms on the Platform. Your continued use of the Platform and Services after any such changes constitutes your acceptance of the new Terms.
